Terms of Service

These terms cover every service Webnetic LLC ("Webnetic", "we", "us") provides to you, the client. By signing up for a plan or using our services, you agree to them. If anything here is unclear, ask us before you sign up.

Our services

We offer:

  • Website plans: the Managed Site Plan, the Startup Plan and the Growth Plan. Each covers a website with hosting, security and ongoing care, at the level the plan describes.
  • Add-ons: WordPress Website Maintenance, CRM Access and Webnetic Insight.
  • Clarity Agent and Clarity Agent Plus: a chat assistant for your website.
  • Quickstart Sites: a small brochure website, sold as a one-time build.

What each plan includes, and its current price, is listed on our pricing page. When you sign up, we confirm your plan and what it includes in writing. If a plan changes later, we tell you before the change affects you.

Billing and payment

Monthly plans and add-ons are billed every month by subscription, through Stripe or PayPal. There is no setup fee and no contract. If a payment fails and isn't settled, we may pause the service until it is.

Quickstart Sites is billed as described in the Quickstart Sites section below.

Cancelling

You can cancel any plan or add-on at any time. You pay for the service up to the end of the current billing month, and nothing after it. We don't refund part months. There's no fee for leaving.

Your website and your content

Your website, its content and your domain belong to you outright, from your first payment. If you leave, we hand them over to you or your new provider at no charge, and help with the move.

Content you give us to publish, including text, photos and logos, must be yours to use, or used with permission. You're responsible for it.

Platforms, hosting and backups

New websites are built on EmDash and hosted on Cloudflare. Online stores are built on WordPress with WooCommerce. We continue to host and maintain the WordPress sites we already look after.

  • EmDash sites: your site's content can be restored to any point in the last 30 days. That restore covers content, not uploaded media files such as images, so keep your own copies of any media you can't replace. The site's code is kept in version control.
  • WordPress sites: hosted on Google Cloud infrastructure and backed up daily.

Moving off WordPress. If you have a WordPress site that isn't an online store and you join a monthly plan, we move it to EmDash at no charge. Keeping your current design is free. A redesign is quoted separately before any work starts.

Revisions and extra work

Each website plan includes a number of revision hours a month, listed on the pricing page. Unused hours don't carry over to the next month. If a request falls outside your plan or what we agreed, we give you an estimate first. We never bill for extra work you haven't approved.

Building your website

We agree a timeline with you at the start of a build. It depends on you getting us content, access and feedback on time. We're not responsible for delays caused by waiting on those.

SEO and the Growth Plan

SEO on the Growth Plan is done on your own website: technical fixes, content and optimisation. It doesn't include link building or off-site SEO. We work to improve your rankings, but search engines change how they rank sites all the time, so we can't guarantee any particular result or position.

Clarity Agent

Clarity Agent is an AI chat assistant we set up on your website.

  • What it knows. It answers only from the facts you give it. You're responsible for keeping those facts accurate and up to date. It's an AI and can still get an answer wrong. When it doesn't know something, it says so and offers to connect the visitor with you.
  • How it behaves. Every conversation opens by telling the visitor they're talking to an AI assistant. It quotes only the prices you choose to list, exactly as written. It doesn't promise dates or availability; it passes those questions to you. It only talks about your business.
  • Limits. Each plan has a limit on facts and on visitor messages a day, shown on the pricing page. Each visitor can send up to 25 messages a day. If your site reaches its daily limit, the chat window shows your phone number and email instead. It only works on the websites you list with us.
  • Leads and records. When a visitor asks for a quote, a booking or a call back, it emails you their details. Conversation transcripts are kept for 90 days. Leads are kept after transcripts are cleared. How we handle visitors' details is covered in our Privacy Policy.
  • Leaving. Month to month, no contract. Everything you teach your assistant is yours, and if you leave we'll send you a copy.

Quickstart Sites

Quickstart Sites is a 5-page brochure website, built in 5 business days for a one-time fee of $299. The 5 business days start once we have your payment and your completed onboarding form. After launch, management costs $19 a month or $190 a year. Updates outside management are billed at $75 an hour.

Confidentiality

Anything confidential you share with us is used only to deliver our services and is kept private.

Your responsibilities

You agree to give us the access, information and approvals we need to do the work. If we can't get them, the work may be delayed or paused, and we're not liable for that.

Limitation of liability

We're not liable for any indirect, incidental, special, consequential or exemplary damages, including lost profits, goodwill, use or data, arising from the use of, or inability to use, our services.

Indemnification

You agree to indemnify and hold harmless Webnetic LLC and its employees, contractors and agents from any claim by a third party, including reasonable attorneys' fees, arising from your use of our services or your breach of these terms.

Changes to these terms

We may update these terms. We'll tell you about changes by email or on our website. Using our services after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Colorado, where Webnetic LLC is registered.
